Please read these Terms and Conditions ("Terms," "Terms and Conditions") carefully before using the AI Video Generator Nova mobile application (the "Service") operated by Mileafy ("us," "we," or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password and for all activities that occur under your account. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You may not use someone else's account or create an account using false or misleading information.

2. Purchases and In-App Credits

2.1 In-App Purchases

The Service offers in-app purchases of credits ("Stars") that can be used to generate AI videos. All purchases are processed through Apple's App Store and are subject to Apple's terms and conditions.

2.2 Pricing

Prices for in-app purchases are displayed in the app and may change at any time. We reserve the right to modify pricing without prior notice.

2.3 Refunds

All purchases are final. Refund requests must be submitted through Apple's App Store in accordance with Apple's refund policy. We do not provide direct refunds.

2.4 Credit Usage

Credits (Stars) are consumed when generating videos. The amount of credits required depends on the video duration and model used. Unused credits do not expire but may be forfeited if your account is terminated for violating these Terms.

3. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Create content that infringes on intellectual property rights or violates any laws
• Generate deepfakes or misleading content intended to deceive or defraud
• Create content depicting minors in inappropriate contexts
• Generate spam, advertisements, or unsolicited communications
• Attempt to reverse engineer, decompile, or extract the underlying AI models
• Use automated systems (bots, scrapers) to access the Service
• Interfere with or disrupt the Service or servers
• Impersonate any person or entity or misrepresent your affiliation
• Violate any applicable laws or regulations

We reserve the right to remove any content and terminate accounts that violate these usage policies.

4. Intellectual Property

4.1 Your Content

You retain all rights to the prompts, images, and other content you provide to generate videos ("Your Content"). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and process Your Content solely to provide the Service.

4.2 Generated Videos

You own the videos generated by the Service using Your Content. However, you acknowledge that:

• The underlying AI models and technology remain our property
• Similar or identical videos may be generated for other users using similar prompts
• You are responsible for ensuring your use of generated videos complies with applicable laws
• We retain the right to use anonymized, aggregated data about video generation for improving the Service

4.3 Service Content

The Service and its original content (excluding Your Content and generated videos), features, and functionality are owned by Mileafy and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

5. Content Moderation

We use automated systems and human review to detect and prevent the generation of inappropriate or harmful content. We reserve the right to:

• Review prompts and generated content for policy violations
• Refuse to generate videos that violate our policies
• Remove content that violates these Terms
• Suspend or terminate accounts that repeatedly violate our policies

Credits will not be refunded for generations that are blocked or removed due to policy violations.

6. Service Availability

We strive to provide reliable access to the Service, but we do not guarantee that the Service will be available at all times or without interruptions. We may:

• Modify, suspend, or discontinue the Service at any time
• Impose limits on video generation capacity
• Perform maintenance that temporarily disrupts access

We are not liable for any interruption, modification, or discontinuation of the Service.

7. Third-Party Services

The Service uses third-party services including:

• Google Cloud Platform and Firebase for hosting and infrastructure
• Google Vertex AI for AI video generation
• Apple App Store for payment processing

Your use of these third-party services is subject to their respective terms and conditions. We are not responsible for the practices or policies of third-party services.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MILEAFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

• The Service will function uninterrupted, secure, or error-free
• Defects will be corrected
• The Service is free of viruses or harmful components
• Generated videos will meet your expectations or requirements

10. Indemnification

You agree to indemnify, defend, and hold harmless Mileafy and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your Content or generated videos

11. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so through the app settings or by contacting us.

All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to a jury trial and to participate in class action lawsuits.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect. The invalid or unenforceable provision will be deemed modified to the minimum extent necessary to make it valid and enforceable.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mileafy regarding the Service and supersede any prior agreements.
